By accessing or using the Fioness platform, including the Fioness Gateway, Fiona AI, or any associated services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). 2. Description of Services

Fioness is a technology ecosystem providing AI assistance, developer infrastructure, gaming, and digital entertainment services. The platform is currently in development; specific products and features may be available in limited preview, in beta, or not yet available. Fioness reserves the right to modify, suspend, or discontinue any aspect of the Services at any time without notice.

All content, branding, technology, and materials within the Fioness platform, including the Fioness name, the Fiana AI system, mascot designs (Pex and Pexsina), the falcon mark, logos, and all associated intellectual property, are owned by or licensed to Fioness. Nothing in these Terms grants you any right, title, or interest in such materials. You may not reproduce, distribute, or create derivative works based on Fioness intellectual property without express written permission.

6. Third-Party Services

The Services may integrate with or link to third-party services, including but not limited to social media platforms, payment processors, and cloud infrastructure providers. Fioness does not control these third-party services and is not responsible for their content, privacy practices, or terms. Your use of third-party services is subject to their respective terms and policies.

7. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Fioness disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Fioness does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, Fioness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of (or inability to access or use) the Services.
